Not legal advice. This is a starting template. Employment law differs by state and city, and some terms may not fit your situation. Have an employment attorney review the letter before you send it.

Background checks follow the FCRA steps

Give the candidate a standalone written disclosure and get written authorization before ordering a consumer report. If the report may lead you to withdraw the offer, send a pre-adverse action notice with a copy of the report and the CFPB summary of rights, wait a reasonable time, then send the adverse action notice. Many states and cities also allow criminal history checks only after a conditional offer like this one.

How the Offer Letter Generator Works

1

Fill in the offer

Enter the company, candidate, job, pay, benefits and conditions. The example shows a full letter; Start blank clears it.

2

Check the state warnings

The work state drives the checks: exempt salary floors, Montana's probationary period, and the pay notices California and New York require at hire.

3

Download and sign

Save the letter as a PDF or Word file, have it reviewed, and send it for signature. No sign-up needed.

What to Include in a Job Offer Letter

A good offer letter answers every question a candidate asks before saying yes, and nothing more. Each line below maps to a field in the generator.

ItemWhy it belongs in the letter
Job title, manager, location, start dateDefines the role the candidate is accepting and when payroll starts.
Full-time or part-time, hoursDrives benefit eligibility and, for hourly staff, expected weekly pay.
FLSA classificationExempt employees get no overtime; non-exempt employees get 1.5 times their regular rate over 40 hours a week.
Pay rate and pay frequencyAnnual salary or hourly rate, and how often payday comes.
Signing bonus and equityOnly if offered. A bonus is supplemental wages, so 22% federal income tax is usually withheld.
Benefits and paid time offA summary; the plan documents control the details.
At-will statementMakes clear the letter is not a contract for a fixed term.
ConditionsForm I-9 work authorization, a background check, reference checks.
Acceptance deadline and signaturesEnds the offer on a set date and records the candidate's acceptance.

Exempt or non-exempt. Calling a job exempt does not make it exempt. Under 29 CFR Part 541 the employee must be paid on a salary basis of at least $684 a week ($35,568a year) and do executive, administrative or professional work. The Department of Labor's 2024 rule raising that floor to $844 and then $1,128 a week was vacated by a federal court in Texas v. Department of Labor in November 2024, the department dropped its appeals, and a May 15, 2026 Federal Register notice restored the $684 figure. Several states set higher floors, and the generator warns when the salary is below the one for your state:

Jurisdiction2026 minimum weekly salaryRule
Federal (FLSA)$684$35,568 a year
California$1,352California requires a salary of at least twice the state minimum wage for full-time work: $70,304 a year ($1,352 a week) in 2026 at the $16.90 minimum wage.
New York$1,275New York's executive and administrative exemptions need at least $1,275 a week in New York City, Long Island and Westchester and $1,199.10 a week elsewhere in the state in 2026.
Washington$1,541.70Washington requires at least 2.25 times the state minimum wage for 40 hours: $1,541.70 a week ($80,168.40 a year) in 2026.
Colorado$1,111.23Colorado's 2026 exempt salary is $57,784 a year (about $1,111.23 a week).
Alaska$1,120Alaska requires at least twice the state minimum wage for a 40-hour week: $1,120 a week since the minimum wage rose to $14.00 on July 1, 2026.
Maine$871.16Maine requires a salary above 3,000 times the state minimum wage: $871.16 a week ($45,300.32 a year) in 2026.

Signing bonuses with strings. If you want a bonus repaid when a new hire leaves early, put that in a separate signed agreement. California's AB 692 (Labor Code § 926) bars most repayment terms in employment contracts signed on or after January 1, 2026, with a narrow exception for sign-on bonuses that meet its conditions. Use the bonus tax calculator to see the withholding on the bonus itself.

Offer Letter vs Employment Contract

An offer letter is a short, at-will summary of the job. An employment contract is a longer agreement that binds both sides to terms such as a fixed term, notice, severance and restrictive covenants. Most small employers send an offer letter for every hire and add a contract only for key roles.

Offer letterEmployment contract
Length1 to 2 pages4 to 10 pages
Employment termAt willAt will or fixed term
Ending the jobEither side, any timeNotice periods, cause definitions, severance
Confidentiality, inventions, non-competeUsually a separate agreementBuilt in
Typical useHourly and staff rolesExecutives, key hires, fixed-term projects

When the role needs more than a letter, build the longer document with the employment contract template. If the person will run their own business and send you invoices, they may not be an employee at all; the 1099 vs W-2 calculator compares the cost of each arrangement.

State Pay Notice Rules Worth Knowing

An offer letter does not replace the written pay notices some states require at hire. The generator adds a sentence pointing to the notice and flags it in the warnings.

  • California, Labor Code § 2810.5.At hire, non-exempt employees must get a written notice with the pay rate and basis (including overtime rates), allowances, regular payday, the employer's legal and trade names, address and phone, the workers' compensation carrier, paid sick leave rights, and any disaster declaration issued within 30 days before the start date. Changes must be given in writing within 7 calendar days unless they appear on the next wage statement. The Labor Commissioner publishes the DLSE-NTE template.
  • New York, Labor Law § 195(1).Every new employee, exempt or not, gets a written notice of pay rate and basis, allowances, regular payday, and the employer's names, address and phone, in English and in the employee's primary language when the state has a template for it. The employee signs an acknowledgment, and the employer keeps it for six years. Templates such as LS 54 (hourly) and LS 59 (exempt) are on the NYDOL pay notice page.
  • Montana, at-will exception. Montana is the only state where an employee who finishes the probationary period can be discharged only for good cause (Mont. Code Ann. § 39-2-904). If the employer sets no probationary period it is 12 months, and the employer can extend it to 18 months in total (§ 39-2-910). For Montana the generator swaps the at-will paragraph for a probationary-period paragraph.

Pay Transparency Laws: Salary Ranges in Job Postings

A growing list of states and cities require a good-faith pay range in job postings, so the salary in your offer letter should usually fall inside the range you advertised. The main laws in effect as of October 2026:

JurisdictionIn effectEmployers covered
ColoradoJanuary 1, 2021All employers
CaliforniaJanuary 1, 202315 or more employees
WashingtonJanuary 1, 202315 or more employees

HawaiiJanuary 1, 202450 or more employees
District of ColumbiaJune 30, 2024All employers
MarylandOctober 1, 2024All employers
IllinoisJanuary 1, 202515 or more employees
MinnesotaJanuary 1, 202530 or more employees
New JerseyJune 1, 202510 or more employees
VermontJuly 1, 20255 or more employees
Cleveland, OhioOctober 27, 202515 or more employees
MassachusettsOctober 29, 202525 or more employees
VirginiaJuly 1, 2026All employers
Maine202610 or more employees
DelawareSeptember 26, 2027 (scheduled)26 or more employees

Connecticut expanded its wage range rule on October 1, 2026 to require the range and a general description of benefits before compensation is discussed. Coverage of remote jobs, the details a posting must list (benefits, bonus, commission) and penalties differ by law, so check the agency guidance for each state you hire in.

Onboarding Forms Checklist for a New Employee

Once the offer is signed, these forms and filings come next:

  1. Form W-4 for federal income tax withholding, collected before the first payroll. Our Form W-4 guide walks through each step.
  2. Form I-9. The employee completes Section 1 no later than the first day of work; you examine documents and complete Section 2 within three business days. Keep it for three years after hire or one year after employment ends, whichever is later.
  3. State withholding certificate in most states with an income tax. A few accept the federal W-4, so check your state revenue department.
  4. New-hire report to the state directory within 20 days of hire under federal law; some states require it sooner.
  5. State pay notice in California (non-exempt employees) and New York, plus any other notices your state requires.
  6. Payroll setup:direct deposit authorization, benefits enrollment, and, for a first hire, state unemployment and workers' compensation accounts.

Run the first paycheck through the paycheck calculator to show the employee their take-home pay, and the payroll tax calculator to see the employer side: Social Security, Medicare, FUTA and state unemployment tax.

Worked Example: Pricing and Checking an Offer

Harbor Lane Coffee Roasters in Austin offers Maya Torres an operations manager job at $62,000 a year, exempt, paid every two weeks, with a $2,000 signing bonus. That is about $1,192.31 a week, well above the federal $684 floor, and Texas sets no higher one, so the letter shows no salary warning.

Switch the work state to California and the same offer is flagged: California's 2026 exempt minimum is $70,304 a year ($1,352 a week). The owner can raise the salary to at least that figure or classify the job as non-exempt and pay overtime. Before sending either version, the employee cost calculator shows what the hire costs with payroll taxes and benefits, and the PTO accrual calculator turns 15 days a year into an hours-per-paycheck accrual rate.
