Colorado Overtime Rules

Colorado pays overtime at 1.5x after 40 hours in a week, 12 hours in a workday or 12 consecutive hours, whichever pays more.

  • 1.5x for hours past 40 in a workweek, past 12 in a workday, or past any 12 consecutive hours.
  • When more than one test applies, the employee gets the one that results in higher pay.
  • Employers cannot average hours across weeks or give comp time instead of overtime pay.

Overtime is taxed like the rest of your pay. A paycheck with extra hours can have more federal tax withheld because payroll annualizes it, and for 2025 through 2028 the federally required overtime premium is deductible on your federal return. The overtime tax calculator estimates that deduction; the paycheck above does not include it.
