New Jersey Overtime Rules

New Jersey has no general daily overtime rule, so most hourly workers follow the federal standard: 1.5x the regular rate for hours over 40 in a workweek.

  • Overtime is 1.5 times your regular rate for every hour over 40 in a workweek.
  • Long days, weekends and holidays do not trigger overtime on their own; only the weekly total counts.
  • Each workweek stands alone: an employer cannot average a 50-hour week with a 30-hour week.
  • Some jobs are exempt, including many salaried executive, administrative and professional roles.

Overtime is taxed like the rest of your pay. A paycheck with extra hours can have more federal tax withheld because payroll annualizes it, and for 2025 through 2028 the federally required overtime premium is deductible on your federal return. The overtime tax calculator estimates that deduction; the paycheck above does not include it.
