The Texas Minimum Wage Act adopts the federal rate. It exempts anyone covered by the FLSA, plus listed groups such as some nonprofits, domestic workers, certain youths and students, and family members.
State law overrides city and county wage rules for private employers, except under public contracts.
Employers in Texas can pay tipped employees a cash wage of $2.13 an hour and count up to $5.12 an hour of tips toward the $7.25 minimum. If tips fall short, the employer makes up the difference. Texas adopts the federal $2.13 cash wage for employees who customarily and regularly receive more than $20 a month in tips.
