The $17.00 downstate rate covers New York City and Nassau, Suffolk and Westchester counties. Home care aides and tipped hospitality workers have separate rates.
These cities, counties or regions set a 2026 rate above the $16.00 statewide floor. Employers pay the highest rate that applies where the work is done. The downstate rate is set by state law; no New York city or county has its own minimum wage ordinance.

Employers in New York can pay tipped employees a cash wage of $10.70 an hour and count up to $5.30 an hour of tips toward the $16.00 minimum. If tips fall short, the employer makes up the difference. This is the food service rate outside New York City, Long Island and Westchester. Downstate, food service workers get an $11.35 cash wage with a $5.65 tip credit. Other hospitality service employees have higher cash wages ($13.30 upstate, $14.15 downstate), and only hospitality employers may take a tip credit.

No increase to the New York minimum wage is scheduled for 2027. New York indexes its rates from 2027, but the state Department of Labor says an off-ramp condition was met, so on January 1, 2027 the rates stay at $17.00 (NYC, Long Island, Westchester) and $16.00 (rest of state). Home care aide rates still rise to $20.00 and $19.00. The governor has proposed changing the off-ramp rules; no change was enacted as of October 30, 2026.
